Legal information

Terms of sale

1. Scope

These terms apply to the services offered on webguardstudio.com: free website review, small website change, email spoofing protection, SOS work on a site that is down or hacked, one-page site, website audit, fixes, brochure site, subscriptions (Maintenance, Security watch, Local presence, Peace of mind, regression guard follow-up), Google Business Profile, professional email, e-invoicing set-up, cybersecurity check-up, check-up of AI-written code, regression guard and security review, and to the sale of the software tools shown on the Tools page (section 15). The signed quote defines the service; where it differs, the quote prevails over these terms.

2. Provider

WebGuard Studio, a business currently being registered, Lannemezan (Hautes-Pyrénées), France — [email protected]. Full details are in the legal notice.

3. Quote and order

Every service is covered by a free written quote, valid for 30 days. The order is final on receipt of the signed quote, or written acceptance (email), and of the deposit where the quote requires one. No work starts without this written agreement.

4. Prices

Prices are in euros, including all taxes, for services and software tools alike. Third-party costs (domain name, hosting, email, invoicing platform) are billed at cost by their providers, directly to the client, unless the quote says otherwise.

5. Payment

Payment by bank transfer. For the brochure site and the regression guard, a 30% deposit is due on order and the balance on delivery. Other services are payable on receipt of the invoice, no later than 30 days after it is issued. Monthly subscriptions are paid in advance each month; annual subscriptions, in advance for the year.

Business clients: any late payment automatically incurs penalties at the European Central Bank rate plus 10 points, and a fixed recovery fee of €40 per invoice (French Commercial Code, articles L441-10 and D441-5). Ongoing services may be suspended after a reminder left unanswered for 8 days.

6. Performance

Timeframes stated on the site and in the quote run from the order and from receipt of what is needed (site address, content, limited access where relevant). Audits, monitoring and the check-up rely on public data or on what the client shows: they are not penetration tests. Before any change to a site, a dated backup is made; rollback is possible.

7. Subscriptions

Monthly subscriptions have no minimum term: cancel by email to [email protected], effective at the end of the current month. Clients are sent a reminder one month before an annual plan renews, and it is never renewed without written agreement. On termination, backups and reports are handed over to the client.

8. Right of withdrawal (consumer clients)

A consumer ordering at a distance has 14 days to withdraw, from the day after the contract is concluded, without giving reasons, by writing to [email protected] (the template below may be used). If they expressly ask for the service to start before that period ends, they owe the amount for the service provided up to withdrawal. A service fully performed before the period ends, at their express request and with waiver of the right of withdrawal, can no longer be withdrawn from (French Consumer Code, articles L221-18, L221-25 and L221-28).

Withdrawal form template — To WebGuard Studio, [email protected]: I hereby give notice that I withdraw from my contract for the provision of the following service. Ordered on: … Name of consumer: … Address of consumer: … Signature (only if sent on paper): … Date: …

9. Warranty

Fixes and the brochure site are covered for 30 days after delivery: any defect in what was delivered is corrected free of charge. The warranty does not cover later changes by the client or a third party, nor provider outages (hosting, domain, email).

10. Liability

WebGuard Studio commits to using the means needed to perform the services properly (best-efforts obligation). A report with no findings does not guarantee the absence of flaws. For business clients, WebGuard Studio's liability is limited to the amount, excluding taxes, paid for the service concerned over the last 12 months, except in case of gross or intentional misconduct.

11. Ownership

Content supplied by the client remains theirs. Once paid in full, the client freely uses the delivered brochure site and the reports. WebGuard Studio's measuring tools and methods remain its property. The client's accounts (domain, hosting, Google profile, email, platform) stay in the client's name.

12. Confidentiality

Client information and report findings are confidential: they are neither published nor shared with third parties. Any flaw found is reported privately to the client only.

13. Personal data

See the privacy policy.

14. Mediation and disputes

In case of dispute, the client first writes to [email protected]; a reply is given within 2 working days. Consumer clients may use a consumer mediator free of charge: details provided upon registration. These terms are governed by French law. Between businesses, any dispute falls under the courts of Tarbes.

The French version of these terms prevails.

15. Sale of software tools

Opening. Sales of the tools are not open yet: no order or payment is accepted before the business is registered (January 2027). People on the waiting list receive a single message when sales open.

What is sold. Each tool is a file delivered by download, with no physical medium. The price is shown including all taxes on the Tools page; it is a one-off purchase, with no subscription. Payment goes through a payment platform whose name and terms are shown before the order is confirmed.

Licence. The purchase gives the client a personal, non-exclusive right, with no time limit, to use the purchased version on their own devices, for themselves or for their business. Reselling, redistributing or making the file publicly available is not allowed. The software remains the property of WebGuard Studio.

What is included. The purchased version and fixes for its bugs. No future updates are promised. Each tool page states what the tool does not do: these limits are part of the product description.

Withdrawal. A consumer client normally has 14 days to withdraw. For digital content supplied without a physical medium, this right can no longer be exercised once the download has started, if the client expressly agreed to this before the end of the period, acknowledged losing their right of withdrawal, and received confirmation of that agreement (article L221-28, 13° of the French Consumer Code). Without these three conditions, the 14-day right of withdrawal applies.

Conformity. A consumer client benefits from the legal guarantee of conformity for digital content (articles L224-25-1 et seq. of the French Consumer Code). A defect reported to [email protected] is fixed; failing that, the purchase is refunded.
